THE BASICS (Rules 1–3)

Point Detail
Made under Proviso to Article 309 and Clause (5) of Article 148 of the Constitution
Who was consulted The Comptroller and Auditor-General, for persons in the Indian Audit and Accounts Department
Came into force 1 December 1965 — Rule 1(2)
Administered by DoPT

Who these rules do NOT apply to — Rule 3(1)

They apply to every Government servant, including every civilian in the Defence Services, BUT NOT to:

# Excluded
(a) Any railway servant (as defined in the Indian Railways Establishment Code)
(b) Any member of the All India Services
(c) Any person in casual employment
(d) Any person subject to discharge on less than one month's notice
(e) Any person for whom special provision is made by law or by agreement approved by the President

Rule 3(4) — if any doubt arises whether the rules apply to a person, the matter is referred to the PRESIDENT, whose decision is final.

The definitions that matter — Rule 2

Term Meaning
Appointing authority Whichever is the HIGHEST of: the authority empowered to appoint to that Service/grade, or to that post, or the authority that actually appointed him, or the authority that appointed him to an earlier permanent Service/post held continuously
Disciplinary authority The authority competent to impose any of the penalties specified in Rule 11
Commission The Union Public Service Commission
Head of the department As declared under the FR & SR or Civil Service Regulations
Head of the office As declared under the General Financial Rules
Secretary Includes a Special or Additional Secretary, and a Joint Secretary in independent charge of a Ministry

Note how "appointing authority" is defined — by the HIGHEST of four possibilities. This matters because a penalty of dismissal or removal cannot be imposed by an authority subordinate to the appointing authority (Article 311(1)).
