POSH Act, 2013 & POCSO Act, 2012
The two laws a Vice Principal carries personal duty under: the ICC, the complaint timelines, and the POCSO reporting obligation whose breach is itself an offence.
THE ONE-MINUTE DISTINCTION (Never confuse these two)
| Basis | POSH Act, 2013 | POCSO Act, 2012 |
|---|---|---|
| Protects | Women (any age) | Children (below 18, any gender) |
| Setting | Workplace only | Anywhere |
| Nature | Civil / administrative — an internal inquiry | Criminal — police, FIR, Special Court |
| Who decides | Internal Committee (IC) | Special Court |
| Ministry | Women and Child Development | Women and Child Development |
| Gender of complainant | Only a woman can complain | Gender-neutral |
| Gender of respondent | Can be any gender | Can be any gender |
| Consent | Relevant — harassment is unwelcome conduct | Irrelevant — a child cannot consent |
| Outcome | Warning, transfer, withholding promotion, termination | Imprisonment, up to the death penalty |
| Complaint window | 3 months (extendable by 3) | No special limitation period (general criminal limitation still applies to offences punishable up to 3 years) |
The single most important line: if the victim is under 18, it is a POCSO matter and the police must be informed — the school's internal committee cannot handle it. POSH is for adult women employees.
