Where candidates lose marks on this
- Applying the 25% quota to every class. Section 12(1)(c) operates only at the entry level — Class I, or pre-primary where that is the admission point; the cohort then moves up.
- Narrowing the minority exemption. After Pramati (2014), both aided and unaided minority schools are outside the RTE Act — not merely unaided ones (that was the 2012 position).
- Mixing POCSO and PoSH. POCSO protects all children below 18, gender-neutral; PoSH protects women at the workplace. A male child victim is a POCSO case, never PoSH.
- Swapping JJB and CWC. Conflict with law → JJB; need of care and protection → CWC. Adoption belongs to neither — CARA regulates it and the DM now passes the orders.
- One age band for everything. RTE rights end at 14; RPWD free education for benchmark-disability children runs to 18. Reading "child with disability" and ticking 6–14 is a classic self-inflicted wound.
- Treating no-detention as still absolute. Since the 2019 Amendment, a State may detain a child who fails the Class 5/8 re-examination — but expulsion before completing elementary education remains prohibited everywhere.
- Calling the Class 5/8 tests "board exams". They are regular school examinations under amended Section 16; Section 30's bar on board examinations until completion of elementary education is intact.
- Wrong RPWD numbers. Benchmark disability is 40%, not 50%; reservation is 5% in higher-education seats but not less than 4% of the vacancies in each group of government posts (3% was the old 1995 figure).
- Scrambling the SMC. It is 75% parents, 50% women, chairperson from among parents — not 50% parents, not 75% women, not head-teacher-as-chair.
- Misusing the RTI clocks. 48 hours is only for life-and-liberty; 35 days only via an APIO; the first appeal goes to a senior officer within the authority (not to the CIC); the PIO penalty is ₹250/day capped at ₹25,000, imposed on the officer personally.
